Hammons v. Tselepsis, Case No. 12-C-98-0327790C Peter T. McDowell represented Ronald Hammons, R&K Automotive and Getty Mart in their suit against their accountant, John Tselepsis, CPA, for professional negligence. Tselepsis agreed to perform personal accounting services for Mr. Hammons as well as accounting services for his two businesses, R&K Automotive and Getty Mart. Tselepsis failed to timely file employment tax returns and made an error in a tax return, all of which resulted in penalties and interest from the IRS. Hammons demanded $27,430. Tselepsis offered $15,000 to settle. After a two day jury trial, the jury returned a verdict in favor of Mr. Hammons for $20,430. Although the jury was capped in the amount of damages it could award, the jury read a gratuitous statement after their verdict indicating that they would have like to have awarded the defendant another $20,000 above what the judge would permit. |
